General Terms and Conditions of Sale (GTC) – Zodalys

These General Terms and Conditions of Sale (hereinafter the “GTC”) govern sales made on the Zodalys website (hereinafter the “Site”) by:

By confirming an order on the Site, the Client acknowledges having read, understood, and accepted the GTC without reservation.

1. Definitions

  • Client: Any adult natural person or legal entity placing an order on the Site.
  • Product: A personalized printed book by Zodalys.
  • Order: The purchase of one or more Products through the Site.
  • Personalization: The integration of information provided by the Client.

2. Scope of Application

The GTC apply to all sales of Products on the Site, excluding all other terms and conditions.

Zodalys reserves the right to modify the GTC at any time. The applicable GTC are those in force at the time the Order is placed.

3. Languages – Governing Version

The GTC may be available in several languages (FR, DE).

In the event of any discrepancy in interpretation between the different versions, the French version shall prevail, unless a mandatory legal provision applicable in the Client’s country of residence states otherwise.

4. Products

4.1 Nature of the Products

The Products sold on the Site are personalized printed books, created based on information provided by the Client.

4.2 Absence of Preview

The Client understands and accepts that they will not have access to any preview prior to production; they will discover the Product upon receipt.

4.3 Interpretive Content

The content of the book is based on interpretations intended for cultural, symbolic, and/or personal development purposes. It does not constitute medical, psychological, legal, or financial advice, nor does it constitute a promise of results.

5. Information Provided by the Client – ​​Liability

5.1 Required Data

For personalization purposes, the Client must provide, in particular: first name, last name, birth name (if applicable), date of birth, time of birth, place of birth, and grammatical preference.

5.2 Accuracy of Information

The Client is solely responsible for the accuracy of the information entered. Any error (e.g., in the time or place of birth) may affect the outcome of the Product.

5.3 Correction After Ordering

If the Product has not yet been shipped by the printer, Zodalys may—where feasible—make a correction upon request.

If the Product has already been shipped, Zodalys will handle the request on a case-by-case basis, without guaranteeing that a modification or re-issue will be possible.

6. Orders

6.1 Process

An Order is deemed placed once the Client validates the payment (immediate payment).

A confirmation email is sent to the Client.

6.2 Order Refusal/Cancellation by Zodalys (Recommended)

Zodalys reserves the right to refuse, suspend, or cancel an Order, particularly in the event of:

  • suspicion of fraud or an attempted circumvention of payments;
  • information that is manifestly inconsistent, incomplete, or unusable for the production of the Product;
  • a payment incident or an abusive dispute;
  • a request that violates applicable laws or infringes upon the rights of third parties.

In the event of a cancellation attributable to Zodalys prior to production, the Client shall be reimbursed for any amounts already collected.

7. Pricing

7.1 Multi-Currency Display

Prices may be displayed in various currencies on the Site. The invoiced amount corresponds to the amount displayed at the time the Order is validated, based on the currency and exchange rate applied by the payment service provider.

7.2 Taxes and Fees

The indicated prices include VAT; no additional fees are charged by Zodalys at the time of the order.

Depending on the country of delivery, fees or taxes imposed by local authorities (customs, import duties, etc.) may apply in exceptional cases; where applicable, such costs shall remain the responsibility of the Client.

8. Payment

8.1 Payment Methods

Payment is processed via Stripe (credit/debit card and/or other methods offered by Stripe, depending on the country).

8.2 Immediate Payment

The Order is payable immediately upon validation.

8.3 Security

Payments are processed through an external service provider; Zodalys does not store credit/debit card data.

9. Delivery

9.1 Delivery Zones

Zodalys delivers to several European countries. The list of countries served is regularly updated and is indicated on the Site at the time of the Order.

9.2 Delivery Method

Shipments are carried out primarily via La Poste (or an equivalent service, depending on the destination).

9.3 Delivery Times

Indicative delivery times and logistical information are specified on the Site (particularly via the FAQ). These times are estimated and may vary, particularly in the event of production constraints, periods of high demand, or transport-related issues.

9.4 Transfer of Risk

Unless otherwise stipulated by mandatory legal provisions, the risk of loss or damage to the package transfers to the Client upon delivery.

10. Right of Withdrawal – Personalized Products

10.1 Principle

Given the personalized nature of the Product (produced according to the Client's specifications), the right of withdrawal is, in principle, not applicable, to the extent permitted by applicable law.

10.2 Issues Upon Receipt / Defective Product / Error Attributable to Zodalys

If the Product exhibits a defect, non-conformity, transport-related damage, or an error attributable to Zodalys, the Client is invited to contact support@zodalys.com, attaching photos of the Product and its packaging.

Zodalys undertakes to seek an appropriate solution (replacement, reprinting, or another solution, as applicable).

11. Warranties

Zodalys applies any applicable statutory warranties. Slight variations related to the printing process (color rendering, paper texture, etc.) do not constitute a defect.

12. Intellectual Property

12.1 Rights

The entire Site, the brand, and all texts, content, layouts, graphics, and creative works comprising the Products are protected and remain the exclusive property of Magnum Diffusion Sàrl or its rights holders.

12.2 Authorized Use

The Client is granted a strictly private right of use for the Product. Any reproduction, public distribution, resale, full online publication, or commercial exploitation is prohibited without prior written authorization.

12.3 Social Media Sharing

The Client is authorized to share excerpts and photos of the Product on social media, provided that such sharing remains reasonable (i.e., not in its entirety) and does not infringe upon the rights of Magnum Diffusion Sàrl.

13. Personal Data

13.1 Processing

Zodalys processes the data necessary for the management of orders, production, delivery, invoicing, and customer service.

13.2 Retention

Data relating to orders may be retained for up to 10 years, particularly to comply with accounting obligations in Switzerland. Information provided for personalization purposes may be retained to facilitate data retrieval in the event of an order-related issue.

13.3 Deletion Requests

The Client may request the deletion of specific data by writing to support@zodalys.com, subject to applicable legal data retention obligations.

13.4 Subcontractors

Zodalys may engage subcontractors (for payment processing, production, or delivery). For reasons of commercial confidentiality, Zodalys is not required to disclose the detailed identities of certain workshops or partners, while nonetheless ensuring that they provide adequate guarantees regarding security and compliance.

14. Limitation of Liability

Zodalys shall not be held liable for indirect damages (loss of opportunity, loss of business, moral prejudice, etc.), to the extent permitted by law.

In any event, Zodalys’s liability is limited to the amount paid for the Order in question, except in cases of gross negligence or where mandatory provisions dictate otherwise.

15. Force Majeure

Zodalys shall not be held liable for any delay or failure to perform resulting from an event beyond its reasonable control (force majeure), including, but not limited to: logistical disruptions, strikes, network outages, unavailability of raw materials, natural disasters, or administrative decisions.

17. Amicable Settlement – ​​Disputes

In the event of any difficulties, the parties shall prioritize an amicable resolution through communication with customer support. Should an amicable agreement not be reached, the dispute may be brought before the competent courts.

18. Governing Law and Jurisdiction

These General Terms and Conditions are governed by Swiss law, subject to any mandatory consumer protection provisions that may apply in the Client’s country of residence. Unless mandatory provisions dictate otherwise, the exclusive place of jurisdiction shall be the registered office of Magnum Diffusion Sàrl, Canton of Vaud, Switzerland.
